Terms of Service

1. Agreement to Terms

By accessing or using DoHyle FMS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms apply to all users including fleet administrators, drivers, and organisation accounts.

2. Description of Service

DoHyle AI is a cloud-based fleet management platform providing GPS vehicle tracking, event recording, driver monitoring, AI-powered dashcam analysis, and related services. The Service is provided by DoHyle Inc. ("Company", "we", "us").

3. Accounts and Access

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account.

Each subscription is tied to a specific company account. Sharing credentials across organisations is prohibited.

4. Subscription Plans and Billing

The Service is offered on a per-vehicle monthly subscription basis. Plans include Basic, Pro, and Enterprise tiers as described on our pricing page.

Subscriptions are billed monthly. Payments are processed securely via Paddle. By subscribing, you authorise recurring charges until you cancel.

Price changes will be communicated at least 30 days in advance.

5. AI Credits

Certain AI features require prepaid AI credits. Credits are purchased separately and consumed as AI features are used. Credits do not expire and unused credits carry over indefinitely.

Credits have no cash value and cannot be transferred between accounts.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse engineer or extract source code
Resell or sublicense access to the Service without written consent
Upload malicious content or interfere with Service infrastructure
Use AI features to process images of individuals without their consent

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Vehicle location data, driver data, and video footage are stored and processed in accordance with applicable data protection laws. You retain ownership of your data.

8. Intellectual Property

The Service, including all software, designs, and AI models, is the property of DoHyle Inc. and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology.

9. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Service Availability

We strive for 99.5% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for downtime caused by third-party services including Claude AI API or telecommunications networks.

11. Termination

You may cancel your subscription at any time. Upon cancellation, access continues until the end of the current billing period. We reserve the right to suspend or terminate accounts that violate these Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Korea. Any disputes shall be resolved in the courts of Seoul, Korea, unless otherwise required by applicable consumer protection law in your jurisdiction.
